3. SMS Program Terms
Program description. Mansion 1886 offers a text messaging program to people who opt in. By opting in to the Mansion 1886 SMS program, you agree to receive recurring marketing and transactional text messages from Mansion 1886 at the mobile number you provide. Messages may include:
Replies to your event inquiry or chat conversation
Tour scheduling, confirmations, and reminders
Updates and coordination for an event you have booked
Requests for feedback or a review after your event
Occasional news, open house invitations, and special offers
How to opt in. You can opt in by checking the text message consent box on a form on our Site, by agreeing in our website chat, or by texting us first. Consent is optional and is not a condition of booking or of any purchase.
Message frequency. Message frequency varies.
Cost. Message and data rates may apply. Check with your mobile carrier for details about your plan.
How to opt out. Reply STOP at any time to cancel. You will receive one final message confirming you have been unsubscribed, and you will receive no further messages unless you opt in again. You may also opt out by contacting us at office@mansion1886.com or 812-850-1184.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.
Your number. You confirm that you are the account holder or authorized user of the mobile number you provide. If you change or give up that number, please reply STOP from it or let us know so we can remove it.
Privacy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.

4. Event Inquiries, Tours, and Bookings
The Site allows you to submit an inquiry, request a tour, chat with us, or otherwise contact us about hosting an event at Mansion 1886.
Submitting an inquiry does not reserve a date and does not create a booking. No date is held and no event is confirmed unless and until:
You have received a written proposal from Mansion 1886, and
You have signed a venue rental agreement, and
You have paid any deposit required by that agreement.
Your signed venue rental agreement governs your event. Information on the Site, including descriptions of spaces, packages, inclusions, availability, and pricing, is provided for general information and may change without notice. If anything on the Site conflicts with your signed rental agreement, the signed agreement controls.
We reserve the right to decline any inquiry or booking request at our discretion, consistent with applicable law.
5. Pricing and Availability
Pricing, packages, and availability shown on the Site are subject to change and may not reflect current offerings. Prices do not include applicable taxes, service charges, or gratuities unless expressly stated. Quoted pricing is binding only when provided in a written proposal issued by Mansion 1886, and only for the period stated in that proposal.
6. Website Chat
The Site offers a chat feature to answer common questions and help you get in touch with our team. Responses may be generated automatically and are provided for general information only. Information provided through chat is not a quote, a reservation, or a binding commitment, and may not reflect current pricing or availability. For anything you intend to rely on, please contact us directly at office@mansion1886.com or 812-850-1184.
When you use chat, we may collect your name, email address, phone number, and the contents of your conversation, and chat conversations may be recorded and stored. Providing your phone number in chat does not sign you up for text messages; we text you only if you separately opt in. See our Privacy Policy for details.
7. Email Communications
If you share your email address with us, you agree that we may send you emails about your inquiry, your event, and news and offers from Mansion 1886. You can unsubscribe from marketing emails at any time using the link in any email. Transactional messages about a booked event will continue as needed.
8. Acceptable Use
When using the Site, you agree not to:
Use the Site for any unlawful purpose or in violation of these Terms
Submit false, misleading, or fraudulent information through any form or the chat feature
Enter a phone number or email address that is not yours
Attempt to gain unauthorized access to the Site, its servers, or any related systems
Introduce viruses, malware, or any other harmful code
Use bots, scrapers, or data-mining tools to access or collect information from the Site
Copy, reproduce, distribute, or create derivative works from Site content except as permitted in Section 9
Interfere with or disrupt the Site or any other user's use of it
Harass, abuse, or send inappropriate content through our forms, chat, or text messages
We may suspend or terminate your access to the Site or our messaging at any time, without notice, for conduct we believe violates these Terms.
9. Intellectual Property
All content on the Site, including text, photography, video, graphics, logos, layout, and design, is the property of Mansion 1886 or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
"Mansion 1886" and associated logos and marks are the property of Mansion 1886. You may not use them without our prior written permission.
You may view, download, and print pages from the Site for your own personal, non-commercial use in planning or considering an event. You may not otherwise reproduce, republish, distribute, sell, or commercially use any Site content without our prior written permission.
If you believe content on the Site infringes your copyright, contact us at office@mansion1886.com with a description of the material and your contact information.
10. Photography and Media
The Site may display photographs and video from events held at Mansion 1886, taken by us or by photographers and videographers we work with. If you believe an image of you appears on the Site and you would like it removed, contact us at office@mansion1886.com and we will review the request.
11. User-Submitted Content
Any content you submit through the Site, including inquiry forms, chat messages, reviews, or testimonials, must be accurate and must not infringe the rights of others.
By submitting content, you grant Mansion 1886 a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating and promoting the venue. We are not obligated to use any submitted content and may remove it at any time.
12. Third-Party Links and Services
The Site may contain links to third-party websites and may use third-party services, including our client portal and proposal system, email marketing platform, chat provider, text messaging provider, and social media platforms. These are provided for your convenience.
We do not control third-party sites or services and are not responsible for their content, availability, practices, or policies. Your use of a third-party site or service is governed by that party's own terms and privacy policy.
13. Disclaimer of Warranties
THE SITE, CHAT, AND MESSAGING SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MANSION 1886 DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site or our messaging will be uninterrupted, error-free, or secure, or that content on the Site is accurate, complete, or current.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MANSION 1886 AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, CHAT, OR MESSAGING SERVICES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, CHAT, OR MESSAGING SERVICES WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
This section does not limit liability that cannot be limited under applicable law, and it does not apply to obligations under a signed venue rental agreement, which are governed by that agreement.
15. Indemnification
You agree to indemnify and hold harmless Mansion 1886 and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Floyd County, Indiana, and you consent to the jurisdiction of those courts.
17. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force.
These Terms, together with our Privacy Policy, are the entire agreement between you and Mansion 1886 regarding your use of the Site and our messaging services. They do not replace or modify any signed venue rental agreement.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
